Expert Legal Guidance for Assisted Reproductive Technology and Surrogacy in India
Understanding IVF and Altruistic Surrogacy in India
Parenthood is a dream many aspire to fulfill. For couples facing infertility challenges, IVF (In Vitro Fertilization) and altruistic surrogacy offer hope and a pathway to building their families. However, navigating the legal landscape of assisted reproductive technology in India requires expert guidance to ensure compliance with the law and protect the rights of all parties involved.
At The DM Law Chambers, we specialize in providing comprehensive legal support for IVF and altruistic surrogacy cases in Delhi and across India. Our experienced team helps intended parents, surrogate mothers, and fertility clinics understand and navigate the legal requirements under the Surrogacy (Regulation) Act, 2021 and related ART laws.

Legal Support for IVF Treatments
While IVF is primarily a medical procedure, it involves several legal considerations, especially when donor gametes (eggs or sperm) are involved or when the treatment is part of a surrogacy arrangement.
Legal Aspects of IVF:
Consent and Documentation – Proper legal consent forms must be signed by both partners undergoing IVF treatment. We help ensure all documentation complies with ART regulations.
Donor Gametes and Legal Parentage – When using donor eggs or sperm, legal documentation is essential to establish parentage rights. We guide couples through this process to avoid future complications.
Embryo Storage and Disposal – Legal agreements regarding embryo storage, usage, and disposal in case of separation or death of partners must be clearly documented.
Medical and Ethical Compliance – We work with fertility clinics to ensure all procedures comply with the Assisted Reproductive Technology (Regulation) Act, 2021.
Altruistic Surrogacy in India – Legal Framework
India’s surrogacy laws underwent significant reform with the enactment of the Surrogacy (Regulation) Act, 2021, which permits only altruistic surrogacy and strictly prohibits commercial surrogacy.
What is Altruistic Surrogacy?
Altruistic surrogacy is an arrangement where a surrogate mother carries a child for intended parents without receiving any financial compensation beyond medical expenses, insurance, and other necessary costs. The surrogate must be a known person without any commercially involved of the intended couple of the intended couple and can only act as a surrogate once in her lifetime.
Key Provisions of the Surrogacy Regulation Act, 2021:
Eligibility for Intended Parents: – Must be Indian citizens, including NRIs and OCI cardholders – Married heterosexual couples only (married for at least 5 years) – Female partner aged 23-50 years; male partner aged 26-55 years – Medically certified as infertile – Should not have any biological or adopted child (with limited exceptions)
Eligibility for Surrogate Mother: – Must be a known person without any commercially involved of the intended couple – Married woman aged 25-35 years – Must have at least one biological child of her own – Can be a surrogate only once in her lifetime – Medically and psychologically fit
Eligibility for Single Women (Widowed or Divorced): – Single women who are widowed or divorced are eligible for surrogacy – Must be aged between 35 to 45 years – Must be an Indian citizen – Must have a medical certificate verifying the need for surrogacy – Must not have any surviving biological or adopted children
Eligibility for Single Men: – Single men are NOT currently eligible for surrogacy in India – The Surrogacy (Regulation) Act, 2021 restricts surrogacy to married heterosexual couples only – Single men, live-in couples, and same-sex couples are excluded from surrogacy arrangements in India
Prohibited Practices: – Commercial surrogacy and advertising for surrogacy services are strictly banned – Exploitation of surrogate mothers is a punishable offense – Sex-selective surrogacy is illegal
